First of all, we would like to thank you for your interest in following and using our services and products.

  1. ACCEPTANCE OF TERMS

The Terms and Conditions (TAC) of this document are as a legal Agreement (User Covenant) between you being a User as an individual, a customer, a partner and the beneficiary of our services provided by www.babylon-booking.com and Moonline Travel and Trade Ltd. (hereinafter referred to as Babylon Booking/or Moonline).

Both sides are also collectively refferd to as “the Parties” and individually as “ the Party”.

By navigating through and using our website for the services we render, you accept, declare and undertake that you have read the User Covenant, completely understand the content and approve all the provisions.

The User is responsible for all User’s Account (under any screen name or Password) and for ensuring that all use of User’s Account complies fully with the provision of this Agreement.

User shall be responsible for protecting the confidentiality of it’s password(s) and credit/debit cards against third parties access to them. Moonline has no responsibility, directly or indirectly relating to the loss suffered or will be suffered by Users and/or third persons because of the negligence of the User to secure, preserve and protect it’s account and access to the Babylon Booking Portal.

Users accept, declare and undertake that information and contents provided by them in the Babylon Booking portal are correct and legal. Moonline is not obliged and responsible to undertake and guarantee to investigate the correctness or faultiness of uploaded, changed or provided information and contents to Babylon Booking by Users or others having access to the User’s accounts as a result of the User’s fault/negligence not to protect the security of its account.

Users can not assign their rights and obligations within the scope of User Covenant partly or as a whole to any third person/party without written permission of Moonline.

Users accept, declare and undertake that they will avoid such behaviors which may manipulate the operation of the Babylon Booking Portal; otherwise, Moonline will compensate any loss it suffers.

Babylon Booking may terminate the membership of a User who is detected not to abide the provisions of User Covenant and the rules stated on the Babylon Booking Portal temporarily or permanently.


Babylon Booking shall have the right at any time to change or discontinue any aspect or feature of its portal.

Moonline reserves the right to update the TAC at any time without notice to User. The most current and updated version of the TAC can be reviewed by clicking on the “Terms and Conditions/Terms of Use” hypertext link located at the bottom of our portal/website.

2. DESCRIPTION OF SERVICES

Babylon Booking is an online Travel portal mainly for air tickets booking dedicated to providing quality services to its partners/clients. We have access to ticketing with more than 700 airlines including low-cost carriers, around the world.

Our portal will gradually extend and launch all other planned travel & tourism related services in a very near future, such as hotel bookings, car rentals, cruises, vacation packages, etc.

The services, including any updates, enhancements, new features, are subject to the TAC.

3. USER CONDUCT

The Babylon Booking portal’s material, trademarks, and other proprietary information, including but not limited to the text, software, photos, videos, graphics and any other content of www.babylon-booking.com are copyrighted as a collective work under international copyright laws.

The User may not modify, publish, transmit, participate in the transfer or sale, or in any way to exploit any of the content, in whole or in part for other purposes that may harm/damage our business and its reputation..

4. MEMBER ACCOUNT AND PASSWORD

If any Babylon Booking services require User to open an account, User must complete the registration process for Login by providing Babylon Booking with the current, complete and accurate information as prompted by the applicable registration form. The user also will choose a password and a user name and protect them. The User is entirely responsible for maintaining the confidentiality of User’s password and account. Furthermore, User is entirely responsible for any and all activities that occur under User’s account, including misuse of its credit/debit card

User agrees to notify Babylon Booking immediately of any unauthorized use of User’s account or any other breach of security. Babylon Booking will not be liable for any loss that User may incur as a result someone else using User’s password, account and credit/debit cards, either with or without User’s knowledge. However, User could be held liable for losses incurred by Babylon Booking or another party due to someone else using User’s account or password to harm our portal. The User may not use anyone else’s account at any time, without the permission of the account holder.

5. SECURITY

You should secure the information by installing security walls such as anti-virus programs on the computer or computers on which you will use the service that you have purchased.

Do not give your information to any person or institution that approach you to give a loan or offer an award. Therefore, you should avoid websites or blogs that contain such ads and posters and you should let us know over the phone in case you receive any suspicious notifications/messages on payment related matters.

With the hosting and technical infrastructure of Babylon Booking, we provide the highest level security system which meets world-class network, data, and physical security conditions. We do the necessary updates regularly by evaluating our security-related policies and applications in accordance with changing conditions and trends.

We take the necessary measurements through SSL, PCI DSS and 3D Secure (3-Domain Secure) within the scope of security.

The SSL (Secure Sockets Layer), is used by the Babylon Booking server to ensure the safe transfer of data between our Users and the system by encoding which are equal to the encoding standards used in banks.

The PCI DSS (Payment Cards Industry Data Security Standard), is used by our portal to ensure card's information security in the credit/debit card payment systems. This system has been developed by the PCI Committee constituted by the institutions such as Visa, Mastercard, American Express, Discover Financial Services and JCB International, which are international credit/debit card providers.

The 3D Secure or also known as the Payer Authentication is an XML-based protocol designed to be an additional security layer for online credit and debit card transactions. It is a system developed to enhance the security of the shopping transactions made with a credit/debit card or a bank card via the internet. With these “secure virtual shopping” solutions developed by Visa and MasterCard, both the card owners and member enterprises are secured against frauds.

6. CANCELLATION / REFUND / REISSUE / VOID

6.1. Cancellation: Any ticket can be cancelled upon request and will be dealt with according to the airline rules for any applicable fees and cancellation penalties to be paid and the most restricted classes will be taken into consideration;

6.2. Refunds:

a. Airline Operation Failure: Either the full amount of the ticket will be refunded to the passenger’s account, or the ticket will be reissued with the new date based on the passenger’s request. This refund is applicable when the Airline fails to operate on the requested & an issued ticket date and the flight is cancelled. This process may take up to 48 hours until the approval is obtained from the Airline;

b. No show Ticket: After approval by the concerned airline, the Customer can receive the relative refund, but only when Moonline receives the refund from the Airline.

6.3. Reissue:

a. Changes: Any ticket can be changed upon request and based on the Airline rules for reissue. The Airline fees will be applied to such changes and the more restricted classes will be taken into consideration;

b. Flight cancellation: In the case of flight cancellation by the airline, the reissue will be processed free of charge. This will take longer than usual until the Moonline gets the approval from the airline;

6.4. Void:

A ticket can be void/cancelled within the same day taken into consideration the time zone/local time differences between the Customer’s country and the country where originally the ticket (s) has been issued. The entire paid amount will be refunded to the Customer’s account. The Void can be applied for all the GDS based airlines. Low-Cost Carriers’ tickets cannot be void according to their airlines’ rules.

7. FORCE MAJEURE

Moonline and the User will not be responsible for any failure or delay in performance of their obligations due to circumstances beyond their reasonable control, including, without limitation, war, riot, embargoes, acts of civil or military authorities, natural disasters such as earthquakes, fire, floods, accidents, power failure, network failure, failures of third party service providers (including providers of internet services and telecommunications), and any other Force Majeure Force and unavoidable related catastrophes that will interrupt Babylon Booking and the User from fulfilling their obligations.

7. Responsibility - Liability

Moonline refuses to bear any responsibility regarding the interruptions in the process of using our services due to errors, loss or deletion of any User’s information, delays in the processor communication errors, computer viruses, extermination or entry in the User’s records as a result of the User’s misusing Babylon Booking Portal and without our permission that can occur and result the violation of the contract, wrongful act, negligence or any other reasons done by the User.

8. TERMINATION

Moonline has the right to immediately terminate User’s account with the Babylon Booking Portal in the event of any conduct by User which Babylon Booking, at its sole discretion, considers to be unacceptable, or in the event of any breach by User of this Agreement’s terms & conditions.

9. DISPUTE RESOLUTION

- If any dispute, difference, controversy or claims arising out of or relating to this Agreement (a ”Dispute”), the Parties (the Customer and Moonline) shall attempt to settle such dispute by mutual discussions between the parties;

- If the Dispute cannot be settled by mutual understanding and discussions, the Dispute shall be submitted to binding arbitration by one arbitrator to be mutually appointed by the Parties;

- The award of the arbitrator shall be final, conclusive and binding upon the Parties and may be entered as a judgment in any court having jurisdiction over either party.

10. ARBITRATION

- The arbitration shall be referred to a sole Arbitrator to be mutually appointed by the Parties to this Agreement;

- All proceedings in such Arbitration shall be conducted in English. The Arbitration shall take place in a location mutually agreed by both Parties.
